DMCA AND COPYRIGHT INFRINGEMENT POLICY

1. Introduction and Legal Basis
1.1. Commitment: BONGO BHUMI PROPERTY CONSULTANCY SERVICES ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects all users and third parties to do the same. This policy outlines the procedures for reporting alleged copyright infringement and for the Company’s response to such claims.
1.2. Governing Law: This policy is established in compliance with the Copyright Act, 1957 of India, and references the general principles outlined in the U.S. Digital Millennium Copyright Act (DMCA) for international best practices in content takedown. Furthermore, the Company complies with its obligations as an intermediary under the Information Technology Act, 2000 (IT Act), and its subsequent amendments and rules.
1.3. AdSense Compliance: The implementation of this Takedown Policy is intended to meet the requirements of digital advertising platforms, including Google AdSense, which mandate a clear policy for handling copyright infringement.
1.4. Scope: This policy governs claims related to content hosted or displayed on the Company’s websites, digital platforms, and in marketing materials (the "Platform").
2. Company’s Intellectual Property
2.1. Protection of Company IP: All materials and content created by the Company, including but not limited to design plans, market reports, financial models, website text, logos, and proprietary methodologies, are protected by the copyright laws of the Republic of India and international conventions.
2.2. Prohibited Use: No content from the Company's Platform or Services may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without the prior written permission of the Company.
3. Reporting Copyright Infringement (Takedown Notice)
3.1. Formal Notice Requirement (DMCA-Style): If you believe that your work has been copied in a way that constitutes copyright infringement, you must provide written notification (a "Takedown Notice") containing substantially the following information:
(a) **Physical or Electronic Signature:** A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
(b) **Identification of Copyrighted Work:** Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
(c) **Identification of Infringing Material:** Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the Company to locate the material (e.g., specific URLs).
(d) **Contact Information:** Information reasonably sufficient to permit the Company to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
(e) **Good Faith Statement:** A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
(f) **Accuracy Statement:** A statement that the information in the notification is accurate, and under penalty of perjury (or equivalent Indian legal statement), that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Takedown and Review Process (IT Act & DMCA)
4.1. Immediate Action (Intermediary Liability): Upon receipt of a valid Takedown Notice, the Company will promptly remove or disable access to the material claimed to be infringing. This action is taken to comply with liability safe harbor provisions under the IT Act and the DMCA.
4.2. Liability Limitation: The Company will not be liable for damages of any nature to any party for removing or disabling access to material, even if the material is ultimately determined not to be infringing.
5. Counter-Notice Procedure
5.1. Filing a Counter-Notice: If you believe that your content was removed or disabled as a result of mistake or misidentification, you may send a written counter-notice (a "Counter-Notice") to the Designated Agent listed in Section 3.2.
5.2. Counter-Notice Content: The Counter-Notice must include substantially the following:
(a) Identification of the material that has been removed or to which access has been disabled, and the location (URL) at which the material appeared before it was removed or access to it was disabled.
(b) A statement, under penalty of perjury (or equivalent Indian legal statement), that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
(c) Your name, address, and telephone number.
(d) A statement that you consent to the jurisdiction of the appropriate court in the Hooghly District, West Bengal, India, and that you will accept service of process from the person who provided the original Takedown Notice.
5.3. Reinstatement: Upon receipt of a Counter-Notice, the Company may forward a copy to the original complaining party. If the complaining party does not file a court action seeking a court order within 10-14 business days, the Company may, in its sole discretion, restore the removed material.
6. Repeat Infringer Policy
6.1. Termination: The Company reserves the right, in its sole discretion, to terminate the account or access of any user or third party who is determined to be a repeat infringer of copyright.
7. Policy Approval and Acceptance
This policy is approved and accepted by the Proprietor of BONGO BHUMI PROPERTY CONSULTANCY SERVICES.
