REFUND AND CANCELLATION POLICY

BONGO BHUMI PROPERTY CONSULTANCY SERVICES (The "Company")

1. General Policy on Fees

1.1. Strictly Non-Refundable: All fees, charges, retainers, and advanced payments ("Fees") paid by the Client to BONGO BHUMI PROPERTY CONSULTANCY SERVICES for Consultancy, Development, Land Arranging, Real Estate Services, or any ancillary services (collectively, the "Services") are STRICTLY NON-REFUNDABLE.

1.2. Irreversible Payment: Payments are deemed earned by the Company upon receipt, as they cover the allocation of Company resources, the initiation of due diligence, internal consultation, opportunity assessment, and market research, regardless of whether the final transaction or project proceeds.

1.3. No Prorated Refunds: In the event that the Company or the Client terminates the Services prematurely for any reason, the Client shall not be entitled to any refund or prorated return of any Fees paid to date.

2. Client Cancellation and Termination

2.1. Client Withdrawal: The Client may cancel or terminate the Services at any time by providing written notice to the Company.

2.2. Financial Consequence: Client cancellation or termination shall immediately forfeit all Fees paid to the Company up to the date of cancellation. The Client remains liable for any outstanding invoices for work completed or costs incurred by the Company prior to the effective date of cancellation.

2.3. Costs and Expenses: If the Client cancels a Service, the Company reserves the right to charge a reasonable administrative fee or charge for any pre-committed expenses, which must be paid by the Client within seven (7) days of receiving a final invoice.

3. Company Termination Rights

3.1. Company’s Right to Terminate: The Company reserves the right to terminate the provision of Services immediately, without liability to the Client and without refunding any Fees, upon written notice if:

(a) The Client fails to make timely payment of any invoice.

(b) The Client breaches any of the provisions set forth in the Company's Terms and Conditions.

(c) The Client provides inaccurate, misleading, or incomplete information necessary for the Service.

(d) The Company, in its sole and absolute discretion, determines that continuing the engagement is impossible, illegal, or compromises the Company’s professional integrity.

3.2. Survival of Clauses: Termination of the Services, whether by the Client or the Company, shall not affect any accrued rights or liabilities of either party, including, but not limited to, the Client’s indemnity obligations and the Company’s right to collect outstanding Fees.

4. Governing Law and Jurisdiction

4.1. Jurisdiction: This Policy shall be governed by and construed in accordance with the laws of the Republic of India.

4.2. Dispute Resolution: Any dispute arising under this Policy shall be subject to the exclusive jurisdiction of the courts located in Hooghly District, West Bengal.
